DarShop Online Store is now available to deliver only within West Malaysia. We are putting effort in planning delivery to East Malaysia, please do wait patiently.

The following terms and conditions apply to all visitors to or users of the DarShop Online Store. By using DarShop Online Store, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you must refrain from using this Website. DarShop Online Store reserves the right to amend any term or condition without prior notice.

 

YOUR ACCOUNT

If you use any DarShop Online Store service, you are responsible for maintaining confidentiality of the information you provide to us. You also consent to accept responsibility for all activities that occur under your account or password. We reserve the rights to refuse services, to terminate accounts, to remove or revise content when any false or misleading information is found.

 

(1) TERMS OF SALES & PURCHASE

1-1.            Definitions

In these terms and conditions:

We” and “us” represents DarShop Online Store, a division under Darson Electronics Sdn Bhd which is a company in Malaysia under registration number 338576-P and having its registered address at Lot-1535, Jalan Dewani 1, Kawasan Perindustrian Dewani, Off Jalan Tampoi, 81100, Johor Bahru, Johor, Malaysia.

You” represents the person, firm or corporation purchasing the Goods indicated in your Sales Oder with DarShop Online Store.

Conditions” represents the general terms and conditions set out in this document and (unless the context otherwise requires) any special terms and conditions agreed in writing between you and DarShop Online Store;

Goods” represents any goods (including any installment of the goods or any parts for them) listed on DarShop Online Store and for the purposes of these terms and conditions includes services;

Sales Order” represents the electronic purchase you have made on DarShop Online Store. This is also the confirmation of your purchase.

1-2.            Our Working Hours

Our working hours is from Monday to Friday, 9:00a.m. -  5:00p.m (excluded public holidays). Any sales order confirmed on Friday or Eve of Any Public Holiday after 2:00p.m., it will be considered as sales order of the following working day. In spite of this, you are still welcomed to shop on our Online Store. 

 1-3.           GST (Goods and Services Tax)

According to Royal Malaysian Customs Department (RMCD), “GST shall be levied and charged on the taxable supply of goods and services made in the course or furtherance of business in Malaysia by a taxable person.” (Refer http://gst.customs.gov.my/en/gst/Pages/gst_sc.aspx)

GST will replace the consumption tax comprising the sales tax and the service tax (SST), and GST will be implemented with effective from 1st April 2015. The standard rate for GST is 6%.

(2) TERMS OF PAYMENT

2-1.            Credit Cards (Visa/Master)

Credit card (Visa/Master) payment option is available to you. Please be assured that we are operating a secure system, credit card information will be protected and will not be given to any third-party.

2-2             Debit Cards (Visa/Master)

ATM cards which have showed Visa or Master on the cards can make direct debit purchases. Please be assured that we are operating a secure system, card information will be protected and will not be given to any third-party.

2-3.            Bank Transfers

This payment option is not available at the moment.

2-4.            Coupons

You may also use our coupons during payment. We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this DarShop Online Store. Only one promotional discount code can be applied to an order. Promotional discount code reflected on digital coupon will be debited when an order is placed. Digital coupon will automatically be redeemed against purchase totals, up to the total purchase amount.

At the same time, please take note that:

  • The digital coupon can only be redeemed on DarShop Online Store;
  • The digital coupon is not redeemable for cash;
  • In the event where the total purchase value is below the coupon value, the excess value of the coupon will not be refunded;
  • The digital coupon cannot be replaced if it is lost, stolen, deleted, or if you cancel or return your purchase;
  • The digital coupon must be used prior to its noted expiration date and within a single transaction;
  • The terms and conditions stated in each digital coupon shall be final and conclusive.

2-5.           Tax Invoice

Tax invoice is generated systematically; as a result, for the purpose of GST and to avoid tax invoice issueing's problem, please kindly fill in your particulars properly.

 

(3) ORDER & DELIVERY

3-1. Pricing     

With respect to items sold by us, we are not able to confirm the price of an item until you place order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of the item sold by us is higher than our stated price, we will, at our discretion, either contact you for instruction before shipping or cancel your order and inform you of such cancellation. Other merchants may follow different policies in the event of a mispriced item. Also, the price of the Goods displayed excludes delivery charges and any other applicable tax.

3-2. Stock Availability

We advice you to check the stock availability with us before placing order. The Goods on our website might not be available or might be a discontinued product.

3-3. Shipping & Delivery

By placing your order, you authorize DarShop Online Store to designate a carrier to deliver the Goods to you.

3-3-1. Shipping Fee

For sales order total above RM99.00, we offer a free shipping fee. However, for sales order total below RM99.00, a shipping fee of RM7.00 will be applied. Your total shipping fee is calculated by adding the “Per Shipping” cost and the “Per Item” cost. You can use our function “SHIPPING AND TAX” on the page when you are processing your order.

3-3-2. Delivery Scheduling & Regulations

  1. All Goods purchased from DarShop Online Store will only be delivered to addresses within West Malaysia. No delivery will be made outside West Malaysia.
  2. If the Goods you would like to purchase are out of stock in our warehouse, we will notify you the lead time.
  3. Generally, the Goods will be arranged for delivery by our designated courier partner and will reach to the address you provided within 1-2 working days. The delivery is available on Monday to Friday between 10:00a.m. and 3:00p.m. For Kelantan, Kedah and Terengganu, the delivery is available on Sunday to Thursday between 10:00a.m. and 3:00p.m. You can track your order online on our courier partner’s website at http://intranet.gdexpress.com/official/etracking.php
  4. If you are not available to receive the Goods from our courier partner at a specific time, please state clearly when you place the order. If the delivery is failed due to the incorrect information (eg. address) you provided, we will assume no liability to any other person for any loss, expense or delay.
  5. Redirection to another address is strictly NOT ALLOWED
  6. We will assume that the Goods are received in good conditions unless you, the receiver, have noted any damage on the courier’s delivery record when receiving the Goods, and please do not sign and kindly reject The Goods. Once you sign on the delivery record, our courier partner will be not responsible for any damage, broken, or dented Goods found.

 

(4) CANCELLATION, EXCHANGE, RETURN AND REFUND

4-1.            Cancellation

  1. You can cancel any purchase that has not yet shipped; however, cancellation charges shall be borne by you if your order is still within 14 days. For your information, charges include bank charges, our account handling charges, documentation charges, and postage charges.

  2. Once the Goods are in delivery process, your cancellation will be subject to return process rather to cancellation process.

4-2.            Exchange

  1. The value of the exchange must be equal to or greater than the order you have made. You may contact our operator to assist you for this issue.

  2. An exchange may have been required if the Goods you had ordered is informed "Out of Stock" by our supplier. You can either wait for the Goods coming (if available) or change the Goods to another Goods.

  3. If you have changed your mind about the Goods you have already placed order, please contact our operator as soon as possible if you would like to do the exchange. Please note that this is only available when your Goods has not yet shipped.

  4. We reserve the right to approve or decline to make any exchange at any reasons or/and circumstances.

4-3.            Return & Refund

We do not accept returns once the Goods have been opened or used, or after 14 days of receipt (and please refer to the 3-2-2-6 under terms of Delivery). However, you can exchange the Goods if the Goods are already damaged or do not work. Before returning the Goods, please contact with our operator to make sure your Goods are eligible for return. Our address is Lot-1535, Jalan Dewani 1, Kawasan Perindustrian Dewani (Temenggong), Off Jalan Tampoi, 81100, Johor Bahru, Johor, Malaysia.

Generally, your return may due to any of the following reasons:

The Goods are damaged in delivery

The Goods do not function as described in its manufacturer specification

Incorrect/wrong Item

Not the Goods you ordered (e.g. wrong size or wrong color)

Missing items/parts

Missing items/parts as indicated in the packaging

Website error

The product does not match website specifications, description, or image (this issue is attributable to a website error/misinformation)

You may request for return of purchased Goods at any time within 14 days of receipt. Once your request for return is confirmed by our operator, our return process is as follow:

  1. Our operator will verify if your reason for return is acceptable;
  2. We will assign our courier partner or others to arrange a pickup for your Goods;
  3. An email will be sent to you as an acknowledgement of receiving your Goods at our warehouse;
  4. We will evaluate the Goods and reply to you the status of the Goods in a week.
  5. If your request for return is accepted, we will inform and reimburse you with a refund via Credit/Debit Card reimbursement.
  6. However, if your request for return is not accepted, we will inform you and deliver back the Goods to you. 
  7. During the whole process of return, there might be a handling charge depend on different situations.

Please note that return cost might need to be paid by you first. Return cost shall be borne by the party attributable to the return request, such as:

  1. You (buyer), where the return is due to your change of mind or the damage is found caused by you; or
  2. We (DarShop Online Store), where the return is due to the defects in the item, delivery of the wrong or different item.

We will refund to you if our officer has verified the cost shall be borne by us.

 

(5)  PRODUCT WARRANTY

Goods are supplied and sold with the warranties issued and granted by the manufacturers or suppliers. Warranty card can be found inside your package. You hereby consent to look solely to such manufacturers or suppliers for any claim related to such warranties.

5-1.      Service Center

You can directly contact or send your Goods to the service center following the address indicated on the warranty card; or, you can contact DarShop Online Store and our operator will assist you for such issues. Please make sure that your Goods are still within warranty duration before you contact any party.

5-2.      Repair Fee

If the Goods are still within the warranty duration and are damaged because of the mechanical or electrical systems, there is no repair fee charged. However, if the Goods are already out of warranty duration, you will be responsible for the repairing fee. For better quality services, you will be suggested to send your Goods to the service center which address is indicated on the warranty card.

5-3.      Lead Time of Repairing

This depends on each supplier. When our operator has confirmed your repairing of the Goods, we will notify you the approximately lead time of the repairing.
